Heartly

Terms of Service

Last updated: October 23, 2026

These terms are an agreement between you and Gemite Labs Inc., an Ontario corporation ("Heartly", "we", "us"), about your use of the Heartly app and the services that go with it. By creating an account you agree to them. If you don't agree, please don't use Heartly.

1. What Heartly is

Heartly helps you keep up with the people who matter to you. You tell it what's happening in their lives, and it reminds you at the right moment. Some features use artificial intelligence (AI) to read what you tell Heartly and to suggest what you might say or give.

2. Your account

3. What you put into Heartly

4. AI features

5. Reminders

Heartly works hard to remind you at the moments you set, but notifications depend on your phone, its settings, your connection, and services run by Apple, Google and others. We can't guarantee that every reminder will arrive, or arrive on time, and you shouldn't rely on Heartly alone for anything where a missed reminder would cause harm, such as medication or legal deadlines.

6. Free and Heartly Plus

7. Using Heartly fairly

Don't:

We may suspend or close an account that does any of these.

8. Ending your account

9. Changes to Heartly and to these terms

We may change or stop parts of Heartly. If we change these terms in a way that matters, we'll tell you in the app or by email before the change takes effect. Using Heartly after that means you accept the new terms.

10. Disclaimers and liability

Heartly is provided as it is and as available. We work to keep it running, accurate and safe, but we don't promise it will always be available, free of errors, or right about what it suggests.

As far as the law allows, we aren't responsible for losses that come indirectly from using Heartly, such as a missed occasion or lost opportunity, and our total responsibility to you for any claim is limited to the greater of what you paid us for Heartly Plus in the 12 months before the claim, or CA$100.

Nothing in these terms takes away rights you have under consumer protection law where you live, or limits our responsibility where the law doesn't allow it to be limited.

11. Law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If we have a disagreement, we'd like to hear from you first at [email protected]; most things can be put right that way. Otherwise, the courts of Ontario will decide it, unless the law where you live gives you the right to bring a claim there.
